Terms and Conditions

These Terms & Conditions govern the use of this website and the purchase of artwork from Martina O’Connor Oil Paintings (“we”, “us”, “our”).

By using this website or placing an order, you agree to these Terms & Conditions.

2. Products

We sell original oil paintings and, where stated, other artwork or related products.

Each original painting is a unique, one-of-a-kind artwork.

Unless otherwise stated, only one original is available for purchase.

3. Product Images

We make every effort to display our artwork accurately.

However:

  • colours may appear differently depending on your screen or device
  • slight variations between online images and the original painting should be expected.

These differences do not constitute a fault.

4. Prices

All prices are displayed in Pounds Sterling (£).

We reserve the right to change prices at any time before an order is placed.

5. Payment

We accept payment through:

  • Stripe
  • PayPal
  • Direct Bank Transfer (BACS)

Orders will only be dispatched after payment has been received in full.

For bank transfer payments, orders remain on hold until cleared funds have arrived.

6. Order Acceptance

Your order represents an offer to purchase.

A contract is formed only when we confirm acceptance of your order.

If a painting has already been sold elsewhere before your order is processed, we will refund your payment in full.

7. Delivery

Artwork is carefully packaged to protect it during transit.

Delivery times are estimates only.

We are not responsible for delays caused by:

  • couriers
  • customs
  • severe weather
  • events outside our reasonable control

8. Risk and Ownership

Ownership of the artwork transfers to you only after payment has been received in full.

Risk passes to you upon successful delivery.

9. Damaged Deliveries

If your artwork arrives damaged:

  • notify us within 48 hours of delivery
  • keep all packaging
  • provide photographs of the packaging and damage

We will work with you and the delivery company to resolve the issue as quickly as possible.

10. Returns

Under the Consumer Contracts Regulations, you may have the right to cancel your order within 14 days of receiving the artwork.

The artwork must be returned:

  • unused
  • in its original condition
  • in its original packaging

Unless the artwork is faulty or damaged, the customer is responsible for return shipping costs.

Refunds will be issued after the artwork has been safely returned and inspected.

11. Commissions

Where commissioned artwork is offered:

  • commissions are created specifically for the customer
  • a deposit may be required before work begins
  • deposits are non-refundable once work has started unless otherwise agreed
  • commissioned artwork is generally exempt from the standard cancellation rights because it is personalised

12. Copyright

Copyright in every artwork remains with the artist unless expressly transferred in writing.

Purchasing an original painting does not transfer copyright.

You may not:

  • reproduce the artwork
  • create prints
  • use it commercially
  • publish it for commercial purposes

without prior written permission.

13. Artist’s Rights

We reserve the right to:

  • photograph artwork
  • display artwork on our website
  • include sold artwork in portfolios
  • use images for exhibitions
  • use images for promotional purposes
  • publish artwork on social media

unless otherwise agreed in writing.

14. Certificate of Authenticity

Where stated, original artwork will be supplied with a signed Certificate of Authenticity.

Loss of the certificate does not affect ownership of the artwork.

15. Website Content

All images, photographs, text, logos and artwork on this website remain our intellectual property unless otherwise stated.

They may not be copied or reused without written permission.

16. Limitation of Liability

Nothing in these Terms excludes liability where it would be unlawful to do so.

Subject to applicable law, our liability is limited to the purchase price of the artwork.

17. Privacy

Your personal information is handled in accordance with our Privacy Policy.

18. Governing Law

These Terms & Conditions are governed by the laws of Northern Ireland.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
